The LIST Card - terms & conditions
Terms and Conditions for agreement between the Diner ('the Diner') and The List Ltd ('The List'):
- The LIST Card provides Diners with access to promotional dining offers from restaurants participating in the LIST Card scheme.The card is personal and non-transferable and is for the exclusive use of the Diner and a single dining guest.
- The LIST Card has an initial minimum membership period of 12 months (unless specifically indicated otherwise in an offer) and operates on an annual membership basis. The renewal date ('the Anniversary') shall be no less than 12 months starting from 10 days after the date on which the Card is purchased. There is an annual fee for the LIST Card. The fee is set by The List and may be varied, with fee changes notified on the LIST Card Diner pages of the LIST website and in renewal notices as outlined in 7 below. The LIST Card remains the property of The List at all times.
- From time to time The List may offer 'Trial member' cards with specific conditions and limitations including, by way of example, the duration of the trial. These terms and conditions, except clauses 2, 7, and 8 will apply to any Trial Membership.
- The Diner must present their current LIST Card at time of dining. Restaurants will retain expired cards and in cases of attempted use by someone other than the Diner.
- Restaurants may offer multiple promotions but the Diner can take up only one promotion at a time. The LIST Card promotion cannot be used in conjunction with any other offers or schemes.
- The Diner must telephone, or call into, the restaurant to request a table and indicate it is a LIST Card booking. Restaurateurs have the right to restrict the overall number of LIST Card Diners at any meal and do not have an obligation to accept bookings at any particular meal.
- Membership shall renew unless the Diner opts out of rolling renewal or The List receives the Diner's request to cancel at least 10 working days prior to the Anniversary. The List will provide the Diner with at least 2 renewal notifications no less than 10 days in advance of the Anniversary. One of these will be no less than 4 weeks prior to the Anniversary. The LIST Card fee will be charged to each Diner on the Anniversary using payment information supplied by the Diner.
- The LIST Card should be kept securely. If the card is lost or stolen, the Diner may apply to The List for a replacement card for which The List will charge a fee of £16. Replacement cards will be issued at The List's discretion and The List may require that the Diner submit details of those restaurants at which the lost card had been used.
- The Diner agrees to ensure their email and other contact information is up to date and to accept charges where The List has communicated to the Diner prior to renewal even if the Diner has not received them.
- The List website contains pages with the definitive guide to current restaurants offering LIST Card promotions. Diners recognise that some restaurants may leave the scheme, others will join and promotions offered may vary. Printed materials, by their nature, will include information that may not be current and the Diner accepts that they may not rely on printed materials.
- The Diner agrees that The List may send them information regarding operation of the scheme including new offers and new restaurants.
- Booking and dining with the LIST Card involves no agency or partnership agreement with The List. Booking and dining is an arrangement between the Diner and the restaurant. The List is unable to enter into any matters of dispute that may arise between the Diner and the restaurant.
- Neither The List nor any group company shall be liable under any circumstances for the use or misuse of the LIST Card. The List shall not be liable for any damages or losses of any nature whatsoever arising out of this agreement.
- The Diner is entering into an agreement for LIST Card services as outlined on pages on www.list.co.uk/card and briefly described in 1. above with The List Ltd (LIST Card Services, 14 High St, Edinburgh EH1 1TE - 0131 550 3050 - card@list.co.uk). The Diner may request a refund for any unused portion of annually paid membership with a pro rata refund for each whole unexpired calendar month less an administration fee of £13.50 by returning the Card and applying in writing to the above address. The List will be under no obligation to grant such a refund, which will be entirely at The List's discretion.
- This Agreement shall be governed and construed in all respects in accordance with the Law of Scotland and the parties hereto irrevocably submit to the non-exclusive jurisdiction of the Scottish Courts.
- These terms and conditions are in addition to the General Terms and Conditions http://www.list.co.uk/terms/ for use of List websites and other services provided by The List Ltd.
I acknowledge and accept these terms and conditions. I understand that on this acceptance, The List will start production of my personalised Card and that this agreement shall commence upon acceptance. I further understand that these terms and conditions will be updated from time to time and will become effective immediately on publication on the List website.
